Terms & Conditions 1. These terms and conditions are important. Please read, as by viewing the pages of this website you acknowledge & accept these terms and conditions. 2. All terms and conditions are subject to the laws of New Zealand. 3. Finest Food Products Limited (‘we’ or ‘us’) reserve the right to change any of these terms & conditions, with such changes effective immediately upon posting to our website. If the terms & conditions change, a notice will be posted to our website advising of this. Privacy 1. The personal information you provide to us will be used only in enabling us to process your order, respond to your queries and provide you with any information you have requested. 2. The personal information you provide will not be disclosed by us to any other person, company or organization. 3. No credit card information is collected or stored on our website. Credit card information is only entered, stored and used on our “DPS Payment Express” secure payment server. Content 1. While we endeavour to supply accurate information on this site, errors and omissions may occur. We do not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission, whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in relying on the content on, or accessed, through this site. Links 1. From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. This does not signify that we endorse or accept responsibility for the content of the linked website(s). 2. You may not create a link to this website from another website or document without our prior written consent. Consumer Guarantees Act 1993 In the event that the transaction the subject of these conditions of sale is subject to the Consumer Guarantees Act 1993 (“the Act”) then: 1. If you are acquiring Products from us for the purposes of a business, then the guarantees and remedies provided under the Act shall not apply to the supply of these Products. 2. In the event that you are acquiring the product for purposes other than that of a business, then these conditions of sale shall be interpreted, to the intent that no provisions shall in any way limit the customer’s rights under the Act. Warranties 1. To the maximum extent permitted by law, all warranties, descriptions, representation or advice given by us as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchantability or otherwise, are expressly excluded. 2. No agent or representative of Finest Food Products Limited is authorized to make any warranties, representations or statements. 3. You shall ensure that the Products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. 4. You expressly acknowledge and agree that we assume no obligation or liability for any advice given and all such Products are accepted by you entirely at your risk. Liability 1. Our liability whether in contract, tort or otherwise for any loss, damage or injury directly or indirectly from any defect in or non-compliance of the Product or any other breach of our obligations hereunder shall not in any event exceed an amount equivalent to the price of the product. 2. We shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall we be liable for any damage or loss caused by your servants, agents, buyers or other persons whatsoever. Price 1. The prices of products are displayed in New Zealand currency. 2. The prices of products are GST exclusive. 3. We may vary the prices at any time for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order. 4. We shall impose a delivery charge which covers the costs associated with picking, packing and delivery of your order. The delivery charge shall be identified and included in the total price at the point of checkout. We are entitled to alter the delivery charge at any time. Payment 1. We accept Visa, Mastercard, Bartercard and Direct Credit for payment of your order. Direct Credit is where you deposit the funds into our bank account, using phone or internet banking or by manually depositing the money in our account. 2. You must pay in full at the time of submitting an order unless other private arrangements are made. 3. You are liable for all costs associated with debt collection where your payment for an order has defaulted. Delivery 1. Orders placed without a street delivery address will not be processed. All required fields on the order form must be completed and credit card information must be verified as correct before orders are processed. 2. Product delivery takes 3-4 working days from receipt of order (within New Zealand). If you do not receive your goods within 7 working days please contact us by e-mailing sales@finestfoodproducts.co.nz We shall use reasonable endeavours to deliver products of acceptable quality to the delivery address (as specified on the order form) on a timely basis. 3. If no person is present at the delivery address at the time of delivery, or if you or any other person fails or refuses to take delivery of the Products, for reasons other than the Products being received in a damaged state, the Products shall be left at the delivery address and be deemed delivered at that point in time. 4. Property and risk in the Products shall pass to you upon delivery to the delivery address. 5. We may choose to part deliver your order if some items are delayed. We shall not charge any extra freight for back orders Return of Goods for Credit or Refund 1. Unless otherwise agreed by us in our absolute discretion, all products are sold on a no return for credit basis unless, the Products are received in a damaged state, are faulty, are supplied in the incorrect quantity or the incorrect Products are supplied. 2. Requests for credit or to return goods must be submitted within 5 days from the date the shipment is received by you by e-mailing sales@finestfoodproducts.co.nz. 3. In the event that we agree to the return of the Products for credit, you will be notified of the appropriate procedure to be complied with to return the Products. 4. Requests for credit or to return goods due to the Products being received in a damaged state will only be considered if the courier company’s consignment note is annotated indicating the problem. 5. Any refunds will be made in the form of the original payment used by you. Refunds will be paid as soon as possible, but in any event, within 21 days. 6. You must arrange for and pay the costs of returning the Products to us at your risk. While in your possession, you must keep any Products you intend to return to us in good condition. |
